There is no automatic mechanism that declares a seat vacant simply because a senator is seriously ill, unconscious, or unable to attend votes for an extended period. That means a senator can remain in office while hospitalized or medically unable to work, and no replacement is triggered unless the senator leaves office through one of those formal routes. In McConnell’s case, despite his prolonged absence and unclear return date, his seat is not legally vacant so long as he remains the sitting senator. If a vacancy does occur, the Seventeenth Amendment governs how it is filled, with state law controlling the details. In Kentucky, a 2024 law requires a special election if a senator leaves office before the term ends, and the governor must appoint an interim replacement from the same political party as the departing senator until the election result is certified. This is different from the House of Representatives, where vacancies must be filled by special election and there is no temporary gubernatorial appointment. In the Senate, however, incapacity alone is not enough; the legal trigger is an actual vacancy, not a medical condition.
