Congress has the final say over rules for federal elections when state and federal law conflict, subject to constitutional review by the courts. The key text is the Constitution’s Elections Clause, Article I, Section 4. But the Constitution’s allocation of power is clear: for federal elections, states set the default rules, and Congress can replace or change them. That distinction matters here because proposals such as voter registration requirements, ballot rules, and identification standards for federal elections raise the question of whether Congress is exercising its Elections Clause power. If it does so validly, federal rules prevail over contrary state rules.
