A Sept. 26, 2022 email from former civil-rights chief Catherine Lhamon told staff the court blocked three guidance documents in 20 plaintiff states, but OCR should keep carrying out its duties without citing those documents.
Investigators concluded that approach was not genuine compliance and said OCR leadership created a path to continue its preferred SOGI policies, with regional offices directed to act in defiance of the order.
The injunction came from a July 2022 Tennessee federal ruling against Biden-era June 2021 guidance after a multistate lawsuit; the Sixth Circuit upheld that injunction in June 2024.
The Education Department had denied wrongdoing in a December 2024 report, but OSC said a supplemental review found major gaps in that response and urged further accountability within the department and before Congress.
