A late-Wednesday court filing showed the Justice Department is seeking extra time to decide whether to intervene on xAI’s side in a Mississippi lawsuit over gas turbines powering its Colossus 2 data center.
Adam Gustafson, a senior DOJ official, said the government may step in if a ruling conflicts with U.S. policy to sustain global AI dominance, citing a Trump executive order to speed AI development.
The NAACP’s suit says xAI and MZX Tech installed 27 unpermitted turbines in Southaven, potentially emitting 1,700 tons of smog-forming pollution a year near a predominantly Black community, and wants the turbines shut pending permits.
xAI argues the turbines are mobile and temporary, making them exempt from stricter air permitting, but a May 6 email reviewed by the Times said the site had nearly 50 mobile gas turbines operating.
