A Gaston County DA report found the Jan. 10 fatal shooting of Derrick Manigault by two undercover officers was legally justified and did not warrant criminal charges.
Surveillance video showed Manigault arguing inside a Gastonia convenience store, threatening people and waving what appeared to be a handgun while officers were conducting a routine alcohol compliance check.
Police said a detective fired to protect himself and others, and Manigault then ran outside still holding the weapon and looked back with it raised; investigators later determined it was a realistic replica gun.
The officers had been on administrative leave during a State Bureau of Investigation review, while Police Chief Trent Conard said Manigault set the events in motion by brandishing the fake firearm.
Manigault's widow, Rebecca Insley, said the released footage omitted most of the encounter outside the store and vowed to keep pressing for what she called the full story and justice.
