June 29 is the new date for David Burke’s preliminary hearing after defense lawyers told a Los Angeles judge they still had not received requested DNA evidence and accused prosecutors of stalling.
Prosecutors said discovery is vast rather than delayed, with about 10 terabytes already turned over from at least 40 terabytes total, and warned completing the process could take months.
Burke, 21, the singer known as d4vd, has pleaded not guilty to first-degree murder, child sex-abuse and mutilation charges in the death of 14-year-old Celeste Rivas-Hernandez; a status conference is set for June 17.
The case centers on allegations that Rivas-Hernandez’s dismembered body was found in the trunk of Burke’s Tesla, alongside other evidence prosecutors have cited including chainsaw and body-bag receipts and blood and DNA from his home.
