Rep. Chip Roy on Tuesday introduced the Deal Death, Face Death Act, which would let prosecutors seek the death penalty when knowingly distributed fentanyl causes a person's death.
The bill would amend the Controlled Substances Act, which now caps punishment at life in prison, and raise fentanyl-related fines to $2 million for individuals and $10 million for entities.
Roy said the measure targets a loophole in cases where heroin, cocaine or methamphetamine is knowingly laced with fentanyl, arguing current law can shield dealers when buyers die.
Nearly 48,400 Americans died from fentanyl poisoning in 2024, according to federal data, though that was a 36% drop from 2023 as Republicans continue pushing tougher narcotics penalties.
