At a Wednesday hearing, Justice Gabrielle Wolohojian proposed deadlines for Auditor Diana DiZoglio to answer Attorney General Andrea Campbell and for Campbell to decide on representation.
The court was hearing Campbell's bid to strike DiZoglio's lawsuit against House Speaker Ronald Mariano, Senate President Karen Spilka and the House and Senate clerks.
Justices said the fight has dragged on too long and highlighted public interest in resolving constitutional questions around the 2024 law, approved by 72% of voters, authorising the audit.
