Rhode Island Judge Melissa DuBose ruled Tuesday that ICE unlawfully detained the Dominican national and said he must get a bond hearing after his April 4 arrest in Worcester, Massachusetts.
DHS said Gomez has a Dominican homicide warrant and an Interpol Red Notice, and that DuBose's order bars ICE from rearresting him despite a deportation order issued the same day.
According to DHS, Gomez entered the US illegally near Lukeville, Arizona, in 2022 and was later caught after local police arrested him on assault and battery charges.
