The justices will hear in the fall a challenge by St. Mary and another Denver archdiocese parish over Colorado's universal preschool programme, which funds 15 hours a week, worth about $6,000.
The schools say Colorado unlawfully bars religious participation by requiring state-funded providers to admit families regardless of religion, sexual orientation or gender identity, despite Catholic teachings on sex and marriage.
The dispute follows a 10th Circuit ruling for Colorado and will test how far the court's 2022 Carson v Makin decision protects religious schools seeking access to generally available public benefits.
