Birchall, who runs Musk's family office and holds roles at xAI and Neuralink, appeared in federal court in Oakland after OpenAI and Microsoft finished cross-examining Musk.
The trial entered its fourth day as Musk alleged OpenAI, Sam Altman and Greg Brockman abandoned the group's nonprofit mission and diverted his roughly $38 million seed donation to commercial uses.
Musk's cross-examination by OpenAI lawyer William Savitt grew heated, and further witnesses could include Brockman and UC Berkeley computer science professor Stuart Russell.
