The 30-year-old South Texas man was taken to Port Isabel Detention Center on Wednesday after the government had agreed to fly him back from Honduras.
His lawyer says he was wrongly deported earlier this year despite valid DACA protection and a pending renewal, and plans to sue the Department of Homeland Security over his renewed detention.
Homeland Security says DACA gives no legal status and he cannot stay; under Trump, at least 261 recipients were arrested and 86 to 174 deported from January to November 2025.
