Hongchi Xiao, 63, was released from a UK prison after about 18 months of a 10-year sentence and returned to the US, the Court of Appeal heard Friday.
Lord Justice Dingemans said Xiao appeared to have been removed under the Facilitated Return Scheme and the Early Release Scheme, with records suggesting departure on 2 July or possibly 30 June.
The same hearing dismissed Xiao’s bid to overturn his 2024 conviction over the 2016 death of 71-year-old Danielle Carr-Gomm, a diabetic participant who stopped taking insulin at his Wiltshire workshop.
Appeal judges said trial directions on a liability waiver did not make the verdict unsafe, adding the waiver had no legal effect in the criminal case.
Xiao had been extradited from Australia for the case; he had also faced prosecution there after a 6-year-old boy died when insulin was withdrawn following one of his workshops.
