Officials will not treat age, skills, or a family’s benefit use as automatic yes-or-no factors. Under the new rule, they must make a “totality of the circumstances” judgment, weighing statutory factors such as age, health, family status, assets, financial condition, education and skills alongside any use of means-tested public benefits. That means a younger applicant with strong education, work history, job skills, a job offer, or other signs of self-sufficiency could still present positive factors even if the household has relied on some benefits. Likewise, weak earning prospects, poor health, limited education, or few assets could weigh negatively if combined with evidence of benefit use. Family members’ benefits are not automatically counted as if the applicant personally received them. In particular, benefits used by a U.S.-citizen child generally are not directly attributed to the parent. But officers may still look at the household’s overall finances and whether the family’s reliance on benefits reflects the applicant’s inability to support the household. The practical effect is broader officer discretion. Receipt of benefits alone does not require denial, but it can now be considered together with age, employability, education, resources and other case-specific facts to assess whether the applicant is likely to become a public charge. USCIS is expected to provide updated guidance and forms before the rule takes effect on September 18.

The policy rescinds a 2022 Biden rule that excluded non-cash aid and lets officers weigh a wider range of support, potentially including Medicaid, housing aid, childcare subsidies and benefits sought for applicants’ children.
DHS said the rule restores self-reliance and protects public resources; it takes effect September 18 and applies to people already in legal status, not undocumented immigrants.
DHS estimated about 950,000 people may drop or avoid enrolling in six benefit programs, and advocates warned the policy could chill aid use by mixed-status families and increase hunger among citizen children.
