Summary
A California federal judge denied SpyGlass and a former Glaukos senior director’s motions to dismiss, allowing Glaukos’ trade-secret-related case to move forward.
Glaukos alleged the ex-clinical research director downloaded more than 11,000 confidential documents before joining SpyGlass and used access to benefit his new employer.
The court found Glaukos adequately pleaded breach of contract, fraud, breach of duty of loyalty and Computer Fraud and Abuse Act claims.
The ruling also accepted allegations that the former director violated his employment agreement by soliciting employees and accessing confidential information for SpyGlass’ benefit.
