Under U.S. law, harsh rhetoric about a president, even in biblical or apocalyptic terms, is usually protected by the First Amendment. The line is crossed when a speaker communicates a serious expression of intent to commit unlawful violence against a specific person, or speaks in a way meant to spur others to immediate violence and is likely to do so. Courts draw that distinction through cases such as *Watts v. United States*, which protected crude political hyperbole, and *Brandenburg v. Ohio*, which set the high bar for incitement: intent, imminence and likelihood. Context matters as much as wording. Investigators look at whether the statement was framed as prophecy, opinion or metaphor, or instead as a direct call for killing; whether it named a target; whether it was conditional or unequivocal; whether the audience would reasonably hear it as serious; and whether the speaker understood the threatening nature of the words. Recent Supreme Court guidance also requires proof of the speaker’s mental state, at least recklessness, not just that listeners felt alarmed.
