European Commission Adds 6 Product Categories to EU Battery Exemption List

Summary
Six new product categories—including wearables such as smartwatches and fitness trackers, electric toys and ATEX equipment—were added to EU exemptions from consumer-removable portable battery rules.
The delegated act keeps the broader Batteries Regulation intact but lets these products rely on battery removal and replacement by independent professionals rather than consumers.
The Commission also updated guidance for manufacturers on applying the new derogations after a 2025 call for applications and consultations with industry, consumer groups, member states and external experts.
The move reflects a balance between repairability and safety, as small lithium-ion batteries are increasingly linked to fires at waste-treatment plants.
The exemption will take effect 20 days after publication in the EU Official Journal unless the European Parliament or Council objects during scrutiny.
