Summary
S$26,350 was awarded to a former area manager after a tribunal found his employer wrongfully dismissed him and failed to meet re-employment obligations when ending his job shortly after he turned 63.
Joel Tan ruled the company had no legal right to treat retirement age as an automatic end to employment and still had to give notice or salary in lieu under the contract and Employment Act.
A 10-day re-employment process fell short because the company offered only a six-month training executive role at S$4,000 a month, down from S$6,428, and gave him a non-negotiable one-week deadline while he was on medical leave.
The magistrate said the Retirement and Re-employment Act generally requires a one-year term unless both sides agree otherwise, and employers should engage workers at least six months before retirement to allow meaningful discussion.
The ruling also ordered S$320 in costs and underscores that employers must either continue employment, arrange a transfer with consent, or pay an employment assistance payment.
