OpenAI Seeks $1 Million From xAI, Urges Judge to Toss Trade-Secrets Suit

What would create liability is evidence that the new employer induced the candidate to bring specific confidential material, knew trade secrets were being disclosed, or used improperly acquired code, data, training pipelines, or other protected know-how. The ruling is especially important in California, where courts reject the “inevitable disclosure” theory. A company generally cannot block someone from joining a competitor simply because they know sensitive information. Suspicion based on employee mobility is not enough; courts want concrete forensic proof of actual misappropriation. In practice, that means AI firms should recruit for skill and experience, not for documents, source code, datasets, customer files, or internal methods from a former employer. They need onboarding controls that tell hires not to bring over confidential files, not to access old systems, and not to paste proprietary material into internal or public AI tools. They also need records showing they took reasonable steps to avoid contamination. The legal risk begins when hiring turns into solicitation of secrets rather than talent.

OpenAI asked a judge Monday to rule that xAI’s trade-secret lawsuit “should never have been filed” and to award it more than $1 million in legal fees.
The filing came hours after xAI, maker of the Grok chatbot, said it intends to appeal the repeated dismissal of claims that OpenAI poached employees and encouraged them to take confidential information.
The latest move extends a feud between Sam Altman’s OpenAI and Elon Musk’s xAI, with the dispute centered on alleged theft of Apple-related secrets and employee recruiting.
