The group says the Joint Committee on Legislative Management allows outside displays in the Capitol but bars those deemed “religious in nature,” making the Nativity rejection unconstitutional viewpoint discrimination.
Jones Day and First Liberty asked the committee to strike that provision and permit the Nativity this Christmas season, arguing the Establishment Clause does not forbid such a display in a public forum.
Connecticut officials had not publicly responded by publication time, leaving open whether the policy will be changed or the dispute will move toward litigation.
