An Ohio federal judge let MXR Imaging’s trade secrets, breach-of-contract and tortious-interference claims proceed, while also preserving a former account executive’s counterclaim for unpaid commissions.
Cross-motions for summary judgment failed because the court found factual disputes over whether a release provision barred MXR’s claims and whether the executive was still owed additional commissions.
The ruling keeps both sides’ claims alive for further litigation rather than resolving the Defend Trade Secrets Act and contract fight before trial.
