Court filings and Justice Department statements in related litigation indicate that Social Security data may have been handled on an unauthorized server, and a judge has now opened discovery to determine what was done with that information, whether any of it was shared outside government, and whether records were preserved. The practical answer is that the data should be subject to federal preservation and records rules, and any improperly held copies would ordinarily be expected to be secured, returned, or deleted under court supervision or agency direction. But there is no public confirmation that this has happened across all agencies. The administration has said there will be no closing report on DOGE, and DOGE’s structure was widely criticized for limiting transparency. That means the fate of the data will likely be decided less by a formal DOGE shutdown process than by litigation, inspector general scrutiny, and agency-by-agency reviews.
