America First Legal said it sued after a May 1 demand letter gave FCPS until May 18 to scrap the policy, pause enforcement during revisions, or add parental notice and an exemption mechanism.
FCPS said it is committed to an inclusive environment for transgender and gender-expansive students and staff, is following state and federal law, and will respond through the legal process after reviewing the complaint.
The suit builds on America First Legal’s recent parental-rights wins in the Ninth and Third Circuits involving school nondisclosure policies on students’ sexual orientation or gender identity.
