8th Circuit Affirms Dismissal of Employment Suit Over Failure to Exhaust Remedies

A 3-judge 8th Circuit panel upheld dismissal of Kelly v. Bisignano, rejecting the plaintiff’s appeal in the employment case.
The 2-page per curiam ruling said the record supported dismissal because the plaintiff failed to exhaust administrative remedies and failed to state a claim.
The court also found no abuse of discretion in the lower court’s refusal to let the plaintiff supplement the record.
