If it slips past Election Day, the process resets and the bill effectively starts over. That said, the executive order is not the same as a durable statutory framework. Its legal footing appears more vulnerable, and several observers expect court challenges. Even supporters of federal action have argued that only legislation can provide a stable national system, especially on NIL, antitrust protections, athlete rights and conference structure. So the order is positioned to define the rules first in practice, but the bill—if Congress eventually advances it—would be more likely to provide the lasting framework.
