Q: When robots capture prisoners without human soldiers, who is legally responsible for their rights?

The legal duty remains with humans and the state, not the robot. Under the Geneva Conventions, responsibility for prisoners of war and other detainees lies with the “detaining power” — the state whose forces captured and hold them. If a Ukrainian ground robot takes prisoners, Ukraine would still be responsible for humane treatment, medical care, registration, access for the ICRC where required, and protection from torture or summary execution. That responsibility can also attach to individual humans in the chain of command. Commanders, operators and others who authorize, deploy or supervise the system can face liability if prisoners’ rights are violated. International discussions on autonomous weapons consistently stress that legal obligations apply to states and individuals, not machines, and that human judgment and control must be preserved. What changes with robots is not the basic rule, but the accountability problem. If a machine captures, misidentifies or mistreats someone without soldiers physically present, it may be harder to determine whether blame lies with the operator, commander, software designer or procurement authority. Legal scholars describe this as a potential “responsibility gap,” but it does not erase the state’s obligations under international humanitarian law. So even in a robot-only capture, the captor state remains legally responsible, and human decision-makers remain the ones who can be investigated or prosecuted if detainee rights are breached.
