Summary
Montana Sen. Tim Sheehy unveiled the Judicial Accountability for Irresponsible Leniency Act, which would strip judicial immunity from federal and state judges in cases where violent repeat offenders are released and later commit another violent crime.
The bill is aimed at judges and government entities that approve bail or other release for defendants with long criminal records, giving victims and their families a path to sue over what Sheehy calls deadly leniency.
Sheehy tied the proposal to several recent killings, including the 2025 stabbing of 23-year-old Iryna Zarutska in Charlotte; the suspect had been arrested and released at least 14 times before the attack.
He also cited cases involving suspects with 39 prior arrests in South Carolina, more than 30 arrests in Virginia, and a Houston defendant accused of killing a man while on three bonds and probation.
The measure broadens the crime-policy fight over bail, probation and judicial immunity, framing repeat-offender releases as a public-safety failure that Congress should address.
