Sean McGinty Loses Tribunal Over 2024 BBC Dismissal for X Posts

A UK employment tribunal rejected Sean McGinty’s unfair dismissal and two disability discrimination claims over his July 25, 2024 firing by the BBC.
The panel said there was no causal link between McGinty’s ADHD and severe anxiety and the gross misconduct allegations tied to his X posts and an email accusing a BBC presenter of “sociopathic” behaviour.
BBC managers had deemed his posts on transgender issues and Hamas to breach social media and editorial rules, and the judgment said the broadcaster reasonably enforced impartiality standards because he kept posting after warnings.
A procedural flaw remained: HR failed to give the disciplinary manager an occupational health report on McGinty’s ADHD before a June 20, 2024 hearing, but the tribunal said a later appeal cured that unfairness.
