A Division Bench of the Chhattisgarh High Court dismissed the Municipal Corporation's appeal and upheld an order directing compassionate appointment for a deceased worker's son.
The court said the mother's job as a Safai Karmachari could not by itself justify rejection, because authorities must examine the family's actual financial distress after losing its main breadwinner.
Judges held the 2013 policy cannot be applied mechanically when its humanitarian purpose is immediate relief, stressing that low-paid employment does not automatically mean a family is no longer in crisis.
The case arose after Ambikapur Municipal Corporation rejected the son's application solely because his mother was already employed, even though the family included the widow, 3 sons and 1 daughter dependent on the deceased employee's income.
