Mark Geragos said Scott Peterson’s team has evidence that could reopen review of his murder conviction, centering on a burned van found near the Peterson home and witness accounts that Laci Peterson was seen alive on Dec. 24, 2002.
Geragos and investigator Ninette Toosbuy argued prosecutors and Modesto police failed to fully test or disclose potentially exculpatory material, including DNA items from the van and multiple reported sightings that, they say, were not properly vetted.
The claims come after a San Mateo County judge on April 27 denied Peterson’s latest bid to overturn the conviction; the Los Angeles Innocence Project said it will appeal and had sought retesting of a broader list of evidence.
A&E’s two-part documentary, “Scott Peterson: The New Evidence,” is set for July 16 and 17, adding fresh public attention to a case stemming from Peterson’s conviction for killing Laci Peterson and their unborn son.
