Judge James Tayler sent Car Sales Solutions' employment dispute back to a tribunal after finding errors in the 2024 refusal to reconsider a 2019 judgment for former worker V Riekstins.
The appeal turned on procedural failings — including mis-addressed emails, confusion over the correct respondent and inconsistent company names — that may have denied the company a fair chance to present its case.
A Southampton tribunal had ruled in 2019 that Riekstins was an employee and awarded £5,280 in unpaid wages plus £1,956 for failure to provide written employment terms after CSS and a related company did not attend.
The reconsideration bid will now be heard quickly by a different Employment Judge, while CSS's separate appeal against the original 2019 ruling remains on hold pending that decision.
