Prosecutors said 17-year-old Cristian Mondragon-Fajardo — accused in 12 Austin shootings over the weekend — is in the U.S. illegally and now faces an ICE detainer.
Six felony charges already filed against him include two counts each of unauthorized use of a motor vehicle and aggravated assault with a motor vehicle, plus firearm theft and evading arrest; he is being held without bond.
Austin police say three suspects ages 15, 16 and 17 fired at apartment buildings, pedestrians and two fire stations, injuring three people and leaving one victim in critical condition.
The detainer requires local authorities to notify ICE before any release and hold him up to 48 business hours, but federal custody would begin only after state criminal detention ends.
The case could complicate any plea deal because immigration consequences may still trigger deportation proceedings after a sentence or parole, according to an immigration attorney cited in the report.
