Virginia Enacts 12-Week Paid Leave Program, First Southern State to Guarantee Benefit

Abigail Spanberger signed House Bill 1207 and Senate Bill 2, creating a Virginia paid family and medical leave program that guarantees eligible workers paid time off for childbirth, illness, caregiving and certain military or violence-related needs.
Up to 12 weeks of leave will be paid at 80% of a worker’s average weekly wage, with benefits capped at 100% of the statewide average weekly wage and self-employed Virginians allowed to opt in.
The program will be run by the Virginia Employment Commission and financed through payroll contributions split between employers and employees, with collections beginning in 2028 before benefits start later that year or by Jan. 1, 2029.
Spanberger said the law is meant to prevent workers from having to choose between a paycheck and caring for family, while positioning Virginia as the first Southern state to adopt paid family and medical leave.
