Nebraska Enacts 90-Day Layoff Notice Law for 100+ Workers, Effective July 18

LB 921 requires Nebraska employers with 100 or more workers to give 90 days’ notice before a mass layoff or covered business closing, with the new state WARN law taking effect July 18, 2026.
The law defines a mass layoff as an employment loss affecting 100 or more employees at a single site in 30 days and requires notices to workers, unions and the Nebraska Department of Labor.
Employers must include worksite details, timing, affected job titles and policy documents, and post notices in every language spoken by at least 5% of the workforce; delays of more than 30 days trigger new notices.
Nebraska allows exceptions for natural disasters, unforeseeable business circumstances and some failed-financing business closings, permits pay in lieu of notice, and can fine violators up to $100 a day without a private right of action.
