Nebraska Enacts 90-Day Layoff Notice Law for 100+ Workers, Effective July 18

  • LB 921 requires Nebraska employers with 100 or more workers to give 90 days’ notice before a mass layoff or covered business closing, with the new state WARN law taking effect July 18, 2026.
  • The law defines a mass layoff as an employment loss affecting 100 or more employees at a single site in 30 days and requires notices to workers, unions and the Nebraska Department of Labor.
  • Employers must include worksite details, timing, affected job titles and policy documents, and post notices in every language spoken by at least 5% of the workforce; delays of more than 30 days trigger new notices.
  • Nebraska allows exceptions for natural disasters, unforeseeable business circumstances and some failed-financing business closings, permits pay in lieu of notice, and can fine violators up to $100 a day without a private right of action.
