Utah’s GOP-controlled legislature in March broadened the state’s gambling definition to include “proposition bets,” and Gov. Spencer Cox signed the measure to ensure prediction markets are barred.
The move targets platforms such as Kalshi, valued at $22 billion, and Polymarket, which argue their event contracts are federally regulated derivatives rather than state-regulated gambling.
That legal clash is already active: Kalshi sued Utah officials in February to block any state ban, while roughly 20 federal lawsuits nationwide have produced split early rulings, including wins in Arizona and setbacks in Nevada and Tennessee.
Utah officials say the platforms are simply betting under another name, and a recent poll found 50% of adults in the state view prediction markets as gambling, versus 30% who do not.
The fight now reaches Washington, where Utah lawmakers have introduced bipartisan House and Senate bills to curb event contracts and reinforce state authority, setting up a possible Supreme Court test.
