Alan Wilson said Friday prosecutors may seek the death penalty if Alex Murdaugh is convicted again at a new trial in the killings of his wife Maggie and son Paul.
The warning follows the South Carolina Supreme Court’s decision this week to vacate Murdaugh’s 2023 double-murder convictions and order a retrial.
The court said former Colleton County clerk Becky Hill improperly contacted jurors, tainting the original trial and forcing the case back to what Wilson called “square one.”
Wilson said all legal options are now open as the state prepares to retry one of South Carolina’s highest-profile murder cases.
